Conditions of Use and Privacy Policy

A version of the Agreement is available in French. In case of divergence between the two versions, the French version prevails over the English version.

The present agreement (hereinafter the “Agreement”) sets out the terms and conditions use as well as the privacy policy of Conexa’s website and its services, immigration and business consulting aimed at business immigrants to Canada. Gestion Conexa Inc., a duly incorporated and registered corporation whose place of business is located at 204 Notre-Dame Street West, # 350, Montreal, Quebec, H2Y 1T3, operates under the trade name Conexa and the www.conexa.ca website (hereinafter “Conexa”).

Conexa reserves the right to modify these terms and conditions at any time and without prior notice.

A – CONDITIONS OF USE OF CONEXA

I: GENERAL CONDITIONS 

The user accepts and acknowledges that Conexa reserves the right, at any time and without warning, modify, change or update the Agreement. The use of the platform by the user after such modification constitutes a consent of the user to respect the conditions of use thus modified and to be bound by them. We strongly recommend that you read these terms of use regularly. If the user does not accept these terms of use or, as the case may be, the terms of use as modified from time to time, or the privacy policy, he must not use the platform and leave the site web www.conexa.ca

II: NOTICE OF DISCLAIMER, EXCLUSION OF WARRANTY AND INDEMNIFICATION

Conexa does not guarantee the accuracy, completeness, quality, suitability or content of the information on the platform. This information is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied terms and warranties of merchantability and fitness for a particular purpose. Information presented on the blogs, videos or other communication methods of the platform cannot constitute a legal opinion. The information must be used for pedagogical and general purposes only. For legal advice or advice tailored to your situation, please consult a lawyer directly. 

Conexa cannot be held liable for any direct, indirect, special, incidental or consequential damages, or any other damage whatsoever, including loss of income, profits or anticipated economic benefits arising from the use or inability to use the platform, the information, documents and software contained therein, with their content, even if Conexa has been warned of the possibility of such damage or even if such damage can be foreseen as a user, you will indemnify Conexa, and release it from any liability for all claims, liabilities, losses and fees (including legal fees) attributable to the use of the platform and violation of these terms of use. 

You may not use or export the information or any copy or adaptation of the information in contravention of the laws or applicable regulations. 

III: MINIMUM AGE

Only users of at least 18 years of age may use and benefit from Conexa’s services.

IV: APPLICABLE LAW AND JUDICIAL DISTRICT

Conexa is based in Montreal, Quebec. This Agreement shall be interpreted in accordance with the laws of the province of Quebec and the laws of Canada which apply in that province. Any dispute relating to the Convention or the use of the online platform must be initiated and concluded in the judicial district of Montreal.

B – PRIVACY POLICY 

The protection of personal information is an important issue for Conexa. Please read this Privacy Policy carefully and review it periodically to be aware of any changes that may be made to it. 

I: SCOPE OF POLICY

This policy applies to all personal information we collect from you through our platform on www.conexa.ca, or in any communication, including in the case of sending and receiving e-mails, telephone exchanges or any other technological means. The policy is intended to govern the collection, use and disclosure of your personal information, regardless of how it was collected (in writing, orally or electronically through the platform).

II: COLLECTION AND USE PERSONAL INFORMATION

Your personal information identifies you, such as your first and last name, home address, email address, home phone number, cell phone number, date of birth, as well as information about your legal file and your conversations and exchanges with our representative and our lawyers, as well as the information on your credit card. The collection of this personal information is done when you purchase a Package or when you communicate with us about our Services. 

We only collect personal information that we reasonably need to provide you with a personalized and high quality service. Personal information may be collected for statistical purposes or for the purpose of improving our services or browsing experience. Under no circumstances will your personal information be shared with third parties without your consent, except in situations specifically provided for in applicable laws, that is, in exceptional circumstances. 

III: COMMUNICATION

We may communicate with our customers through electronic messages/emails. Thus, when you subscribe to our website, when and if applicable, you can expressly consent or not to receive our newsletters and to be added to the list of emails. It is also possible that Conexa will provide information, including personal information provided on a voluntary basis, to its promotional and marketing agencies and direct mail agencies. If you do not wish or no longer wish to receive emails we send to our customers, you can unsubscribe at any time by updating your profile or by following the unsubscribe link at the bottom of all emails we send.

IV: CONSENT

By submitting personal information to Conexa and using our platform, you agree that Conexa can collect, use and communicate such personal information in accordance with the present privacy policy and subject to the terms and conditions permitted or required by law.

V: DATA ANALYSIS

The statistical information we collect is not related to your personal information and is not used to identify you. The web analytics tool we use is Google Analytics (google.com/analytics). This data is automatically collected by analysis tools and is intended to give us guidance on the habits of our customers and their buying process. In order to collect this data, we use cookies, which are small files stored automatically on your computer when you visit our platform. At any time, you can reconfigure the browser on your computer to no longer allow cookies, or remove cookies from your browser. By using our platform without deleting, disabling, or preventing the recording of cookies, you implicitly consent to the collection, use, and disclosure of information necessary to implement their features.

VI: ACCESSIBILITY

You have access to information we hold about you and you can correct it if necessary. Any information relating to your file must be kept for a minimum period of 7 years, in accordance with the requirements to which Quebec Bar members need to stay in conformity.
